Land and its Borders in International Law

Center for Political Studies Presentations address current issues, examine completed studies from new perspectives, and include them in the academic agenda.

Ali Osman Karaoğlu will be the guest of the presentation organized by the Center for Political Studies. Hüseyin Önal will moderate the program in which Ali Osman Karaoğlu will examine the issue based on his book study titled “Determination of Land and Borders in International Law”.

Throughout history, human societies have determined borders by building walls, following rivers, taking into account settlements or other methods, and with the effect of geographical discoveries and technological developments, the borders of the land country began to be drawn more clearly over time. Thus, the principles regarding the land territory and its borders gradually became more and more established in international law and became frequently used tools both between the 16th and 20th centuries when colonial activity deepened and in the post-1945 period when the colonies were dismantled. However, the determination of the land territory and its borders remains an important issue of international law today. Indeed, many disputes over territories such as Crimea, Nagorno-Karabakh, Kashmir, Palestine, Chagos, or islands and reefs with disputed status are still ongoing. From this perspective, reducing territorial and border disputes between states is also important for the maintenance of international peace and security.

States consider the protection of their borders vital and sometimes resort to the use of force. In some regions, the struggle between the central government and separatist movements can then continue as territorial and border disputes. This presentation aims to explain the basic legal framework for the determination of territories and borders in light of inter-state disputes and international judicial decisions. In this sense, the concept of territory and borders from colonialism to the present day, the criteria used by the International Court of Justice in its decisions on territoriality and borders, disputes in Turkey's history, and issues such as self-determination or the use of force regarding the borders of territorial territory will be discussed in detail.
